But flags, the anti-flamewar algorithm, and other automatic adjustments that aren't moderator actions may definitely be contributing.
So, maybe it's a huge conspiracy, or, alternatively, maybe it's a case of a person who attempted to reverse engineer the HN ranking algorithm missing a couple terms in the equation.
Everyone can apply their own form of Occam's Razor. Some will conclude conspiracy, others, missed second and third order terms.
Create of Quality New here. You are probably right here. The raw ranking formula is right, but I am lumping in the additional adjustments from the flamewar filter, etc. with "penalties." I will clarify that.
